1. Introduction, lead passenger and contract
These Terms and Conditions apply when you book a private day tour directly with ED PRIVATE TOURS LTD. In these terms, “you” and “your” mean all passengers included in the booking. The person making the booking confirms that they have authority to accept these terms on behalf of everyone included in the booking. “Written” or “in writing” includes email.
2. Website information, prices and availability
We prepare website information and prices with reasonable care. Errors or changes may occasionally occur, and we may correct them before a booking is confirmed. All tours are subject to availability. An enquiry does not reserve a date, itinerary or vehicle.
3. Payment and booking confirmation
Unless we expressly agree otherwise in writing, full payment is required at booking. A binding booking exists only when ED PRIVATE TOURS LTD has issued written confirmation and received the required payment. The confirmed price applies to the agreed private-tour service and does not include items stated as excluded.
4. Admission fees and personal expenses
Admission fees and optional attraction tickets are not included unless expressly stated otherwise in the confirmed booking. Food, drinks, refreshments, tastings, shopping and other personal expenses are also not included. Customers are responsible for paying for these items directly.
5. Changes by ED PRIVATE TOURS LTD
We will use reasonable efforts to provide the confirmed tour as planned. Minor changes to route, timing, transport or stops may be necessary because of weather, traffic, road or attraction closures, safety considerations or other practical conditions. We will try to tell you about a minor change as soon as reasonably possible.
If we need to make a significant change to a material part of the confirmed tour, we will tell you as soon as reasonably possible and explain any effect on the price. Where practical, you may choose an available alternative tour of equivalent or higher quality, an available lower-value alternative with an appropriate refund of the difference, or cancellation with a full refund of all amounts paid. If ED PRIVATE TOURS LTD cancels the complete tour, we will refund all amounts paid.
6. Customer-requested changes
Please request changes as early as possible and in writing. Changes are not guaranteed and may depend on timing, availability, route practicality and additional costs. A change is confirmed only when ED PRIVATE TOURS LTD confirms it in writing. If we cannot accommodate a requested change and you choose to cancel, the normal cancellation policy applies.
7. Cancellations by customers
Please send cancellation requests using the confirmed booking contact details, preferably by email. A cancellation takes effect when it is received by ED PRIVATE TOURS LTD. Where a refund is due, ED PRIVATE TOURS LTD will process it within 14 days after confirming the cancellation and refund entitlement. The time taken for the funds to appear in the customer’s account may depend on the customer’s bank, card issuer or payment provider.
Cancellation summary
- More than 24 hours before departure: Refund of the amount paid, less the non-refundable payment-processing fee of 3.27% of the tour price.
- Less than 24 hours before departure: No refund.
- No-show: No refund.
- If Ed Private Tours cancels: Full refund of all amounts paid.
8. Missed departures and no-shows
Customers are responsible for being ready at the confirmed meeting point and time. A missed departure or no-show is not refundable.
9. Pickup and drop-off
The standard meeting point is 17 Charlotte Square, Edinburgh. Pickup and drop-off at another suitable address within Edinburgh may be requested in advance. Pickup or drop-off outside Edinburgh is available only by individual agreement.
10. Special requests
Please tell us about special requests before booking. We will make reasonable efforts to accommodate them, but a special request is guaranteed only where it is expressly confirmed in writing as part of the booking.
11. Passenger conduct
Customers must behave safely and respectfully, follow reasonable instructions from the driver-guide and avoid conduct that endangers people or property, is unlawful, or seriously disrupts the tour. We may refuse or end participation where serious unsafe, unlawful or disruptive conduct makes this necessary. In that event, no refund will be due for the unused part of the tour, except where required by law. Disability, legitimate medical requirements and reasonable accessibility needs are not misconduct.
12. Children, child seats and service animals
Children are welcome. Appropriate infant, toddler and booster seats can be provided when requested in advance; please provide each child's age, approximate weight and required seat type when booking. Only service animals are allowed.
13. Smoking and vaping
Smoking and vaping are not allowed inside the vehicle.
14. Accessibility and medical requirements
Please tell us about mobility, accessibility, medical or luggage requirements before booking so we can discuss whether the tour is suitable. A suitable vehicle is selected for the group and tour requirements; no particular vehicle model is guaranteed.
15. Liability and separate arrangements
ED PRIVATE TOURS LTD will take reasonable care in providing the agreed service. Subject to the paragraph below, we are not responsible for losses caused by matters outside our reasonable control, personal belongings, customer actions, or services and facilities provided independently by attractions, restaurants or other third parties. We are not responsible for flights, trains, accommodation or other arrangements that you purchase separately and that are not included in the confirmed booking.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or the customer’s statutory rights. Nothing in these terms affects rights that cannot lawfully be excluded under applicable consumer law.
16. Complaints
If something is not right during your tour, please tell your driver-guide as soon as reasonably possible so that we have an opportunity to assist. Where reasonably possible, please send any unresolved complaint in writing within 28 days after the tour, with the booking details and a clear description of the issue. This does not affect your statutory rights.
17. Data protection
We use personal information to manage enquiries, bookings and tour arrangements. Please read the Ed Private Tours Privacy Policy for further information.
18. Events outside reasonable control
ED PRIVATE TOURS LTD is not responsible for delays, changes or failures caused by events outside our reasonable control, including severe weather, road conditions, traffic incidents, public restrictions, industrial action or attraction closures.
19. Severability
If any part of these terms is found invalid or unenforceable, the remaining terms will continue to apply.
20. Governing law and jurisdiction
These terms are governed by the law of Scotland. The Scottish courts will have jurisdiction where applicable. This does not affect any mandatory consumer protections that apply to you.
